1. Introduction
Welcome to Byalmaklub. These Terms and Conditions govern your access to and use of our website and the purchase of products. By using our website or placing an order, you agree to these Terms.
2. Use of the Website
-Users must be 18 years or older.
-Users must not misuse the website or its content, including spam, offensive material, or infringement of intellectual property rights.
-Accessing the website does not create any commercial relationship unless a purchase is made.
Intellectual Property: All designs, prints, illustrations, and website content remain the property of Byalmaklub. Buyers acquire a personal use license only. Commercial use, reproduction, or resale is prohibited.
3. Products and Orders
-All products are made to order after payment confirmation.
-Product images may slightly differ from the actual items due to monitor settings or printing variations.
-Byalmaklub reserves the right to correct any errors in product descriptions or prices before confirming an order.
Order Acceptance: Orders are accepted once payment is confirmed and production begins. Once production has started, changes or cancellations are generally not possible.
4. Prices and Payment
-Prices are in euros (€) and include applicable taxes where required.
-Shipping costs are calculated at checkout; free shipping applies for orders over €75.
-Accepted payment methods: Credit/Debit Card, PayPal, or others specified at checkout.
-Payment must be completed before production begins.
5. Taxes and Customs
All orders placed on Byalmaklub may be subject to additional taxes, VAT, or customs duties depending on the delivery location. These charges are the sole responsibility of the buyer.
–Canary Islands: Orders are generally exempt from additional indirect taxes under the applicable special regime.
–Mainland Spain & Balearic Islands:
Orders shipped from the Canary Islands to mainland Spain and the Balearic Islands are usually subject to customs procedures upon arrival.
In most cases, the customer will be required to pay:
-Import VAT (21%)
-Customs clearance fees (DUA)
These charges are not included in the product price or shipping cost and are set by the customs authorities in the destination country. Payment is usually requested upon delivery or during the customs clearance process through Correos or the corresponding courier service.
Not all shipments go through the same level of inspection, but these charges are commonly applied for orders shipped to mainland Spain.
–European Union & International Orders: Purchases are considered exports. Local import taxes, VAT, customs duties, or other fees may be charged by local authorities. Byalmaklub has no control over these charges, and the customer is fully responsible.
Important: By placing an order, the customer acknowledges and accepts responsibility for any taxes, VAT, customs duties, or import charges that may apply.
We strongly recommend checking local import regulations before placing an order.
6. Shipping and Delivery
-All orders are made on demand and prepared within 1–5 business days.
–Estimated delivery times:
·Canary Islands: 3–7 days
·Mainland Spain, Balearic Islands, Ceuta and Melilla: 5–12 days
·Europe: 7–15 days
·International: 15–20 days
-After shipping, you will receive a tracking number via email.
-Risk passes to the customer once the order is handed over to the carrier.
-Ensure your delivery address is correct; incorrect addresses may incur reshipping costs.
-Any delay, damage, or loss should be reported immediately to hello@byalmaklub.com.
7. Returns and Refunds
-Please see our Returns & Exchanges Policy.
-Products made to order are generally not refundable, except in cases of manufacturing defects or shipping damage.
-Errors in size, color differences, or misuse are not covered.
This policy does not affect the legal rights granted to consumers under applicable consumer protection laws.
8. Privacy
-Use of our website implies consent to our Privacy Policy.
-Cookies are used for cart functionality, analytics, and optional marketing purposes.
9. Limitation of Liability
-Byalmaklub is not responsible for damages caused by third-party services, delivery delays, or technical issues outside our control.
-Liability is limited to the cost of the affected product in case of proven defect.
10. Consumer Rights
-These Terms do not affect the legal rights granted to consumers under applicable consumer protection laws.
-Consumers may exercise rights such as access, rectification, or complaints according to Spanish and EU law.
11. Governing Law and Jurisdiction
Any dispute shall be submitted to the ordinary courts in Spain, unless mandatory jurisdiction rules state otherwise.
These Terms are governed by Spanish law.
